Tie vote in an election

If an election fails because two or more candidates get the same number of votes, the tie is broken by drawing lots. The chief election officer does this for state elections, and the county clerk does it for county elections.

In case of the failure of an election by reason of the equality of vote between two or more candidates, the tie shall be decided by the chief election officer or clerk in the case of county elections by lot.
