Willfully disobeying a superior officer

This section covers a service member who willfully disobeys a lawful order from a superior officer. The punishment depends on whether it happens during war or not. During war, confinement can be up to ten years or other court-martial punishment. At other times, a court-martial decides the punishment.

The statute, as written — Wilfully disobeying superior commissioned officer

Any person subject to this chapter who wilfully disobeys a lawful command of that person's superior commissioned officer shall be punished: (1) If the offense is committed in time of war, by confinement of no more than ten years or other punishment as directed by a court-martial; and (2) If the offense is committed at any other time, by punishment as directed by a court-martial.
