HRS §124B-16

No punishment before trial

This section says a person held for trial or waiting for a verdict cannot be punished beyond arrest or confinement for the pending charge. The arrest or confinement must be no harsher than needed to keep the person in court. Minor discipline for breaking jail rules is allowed.

The statute, as written — Punishment prohibited before trial

Subject to section 124B-93, no person while being held for trial or awaiting a verdict shall be subjected to punishment or penalty other than arrest or confinement upon the charge pending against the person, nor shall the arrest or confinement imposed upon the person be any more rigorous than the circumstances require to insure the person's presence; provided that the person may be subjected to minor punishment during that period for infractions of discipline.
