Aiding the enemy

This section makes it a crime to help the enemy in wartime, including giving supplies, money, or information, or communicating with them. It applies to anyone who does these things on purpose. Punishment is decided by a military court.

The statute, as written — Aiding the enemy

Any person who: (1) Aids, or attempts to aid, the enemy with arms, ammunition, supplies, money, or other things; or (2) Without proper authority, knowingly harbors or protects, gives intelligence to, communicates or corresponds with, or holds any intercourse with the enemy, either directly or indirectly, shall be punished as directed by a court-martial.
