Drunkenness and other incapacitation offenses

This section covers military members and certain others under this chapter. It says being drunk on duty, being unable to do your duty because of alcohol or drugs, or being drunk while a prisoner are offenses. Punishment is decided by a court-martial.

The statute, as written — Drunkenness and other incapacitation offenses

(a) Any person subject to this chapter who is drunk on duty shall be punished as directed by a court-martial. (b) Any person subject to this chapter who, as a result of indulgence in any alcoholic beverage or any drug, is incapacitated for the proper performance of duty shall be punished as directed by a court-martial. (c) Any person subject to this chapter who is a prisoner and is drunk while the person is a prisoner shall be punished as directed by a court-martial.
