How courts announce verdicts and decide punishments
This section explains how military courts announce their decisions and who decides the punishment. The court must tell the parties the verdict and sentence as soon as they are ready. Depending on the type of court and the accused's choice, either the judge, the members, or the court itself will set the sentence.

The statute, as written — Findings and sentencing
(a) A court-martial shall announce its findings and sentence to the parties as soon as determined. (b) Except as provided in subsection (c), if the accused is convicted of an offense in a trial, the military judge shall sentence the accused. (c) If the accused is convicted of an offense by general or special court-martial consisting of a military judge and members and the accused elects sentencing by members under section 124B-44, the members shall sentence the accused. (d) If the accused is found guilty of an offense in a trial by summary court-martial, the court-martial shall sentence the accused.
