State can take land for mining roads and lines

The State may choose to take private land or rights to use land for roads, power lines, or other facilities needed for mining. It can buy the land, negotiate for it, or use eminent domain. The State can then give, rent, or transfer those rights to mining companies.

The State may, at its discretion, acquire by eminent domain, by negotiation or otherwise, such real property, rights-of-way, and interest in, over, across, under, and through any real property which may be necessary for the transportation or communication facilities in connection with any mining operations and may assign, lease, or otherwise transfer such property or rights to persons or corporations engaged in mining operations.
