What counts as state marine waters

This section defines state marine waters for the whole chapter. They start at the highest point waves wash on shore and go out to the limit of the state's authority, including the U.S. territorial sea. This definition applies even if other laws say something different.

The statute, as written — State marine waters

As used in this chapter, state marine waters shall be defined as extending from the upper reaches of the wash of the waves on shore seaward to the limit of the State's police power and management authority, including the United States territorial sea, notwithstanding any law to the contrary.
