Protections for buyers of vessels in normal sales

This section says that a buyer who buys a vessel in the ordinary course of business keeps the same legal protections as other buyers, even if the title paperwork was not completed. For other buyers, their rights are covered by the general commercial code, except for special rules in other sections.

The statute, as written — Rights of purchaser other than secured party

(a) A buyer in ordinary course of business has the protections afforded by sections 490:2-403(2) and 490:9-320(a) even if an existing certificate of title was not signed and delivered to the buyer or a new certificate listing the buyer as owner of record was not created. (b) Except as otherwise provided in sections 200A-17 and 200A-24, the rights of a purchaser of a vessel that is not a buyer in ordinary course of business or a lien creditor are governed by chapter 490.
