HRS §263-6

How aircraft collision damage is decided

This section says that when one aircraft hits another on land or in the air, the owner's responsibility for damage is decided using the same rules that apply to accidents on the ground. It does not create special aviation rules.

The statute, as written — Collision of aircraft

The liability of the owner of one aircraft to the owner of another aircraft, or to aeronauts or passengers on either aircraft, for damage caused by collision on land or in the air, shall be determined by the rules of law applicable to torts on land.
