New microgrids are not public utilities

A person who builds, keeps, or runs a new microgrid is not treated as a public utility just because they serve participating customers. This rule does not apply to member-owned cooperative electric utilities.

Notwithstanding any other law to the contrary, a person that constructs, maintains, or operates a new microgrid shall not be considered a public utility under section 269-1 solely as a result of furnishing service through that new microgrid to participating consumers. This section shall not apply to a member-owned cooperative electric utility.
