How to ask a court to change a health care decision

This section lets a patient or someone acting for them, or a health care provider, ask a court to stop or order a health care decision. The court can also give other fair remedies. Court rules for this type of case are in another part of the law.

The statute, as written — Judicial relief [§327E-14] Judicial relief

On petition of a patient, the patient's agent, guardian, or surrogate, or a health-care provider or institution involved with the patient's care, any court of competent jurisdiction may enjoin or direct a health-care decision or order other equitable relief. A proceeding under this section shall be governed by part 3 of article V of chapter 560.
