Rules for exempting food from labeling

This section lets the state health director make rules to exempt certain foods from labeling requirements. The exemption applies only to food that will be processed, labeled, or repacked in large amounts at another place, and only if the food is not adulterated or misbranded when it leaves that place.

The director may adopt regulations exempting from any labeling requirement of this part food which is, in accordance with the practice of the trade, to be processed, labeled or repacked in substantial quantities at establishments other than those where originally processed or packed, on condition that such food is not adulterated or misbranded under the provisions of this part upon removal from such processing, labeling or repacking establishment.
