HRS §342L-37

Tank removal does not end cleanup duties

Taking an underground storage tank out of the ground does not excuse the owner or operator from following the cleanup and other rules that applied before removal. The state department will make rules for closing or changing the use of tanks to prevent future leaks.

The statute, as written — Underground storage tank and tank system change in service and closure requirements

Nothing in this chapter shall be construed to relieve the owners and operators of underground storage tanks and tank systems that have been removed from the ground of any responsibility to comply with the release response provisions in this chapter and any other requirements applicable to these owners and operators prior to the removal of the underground storage tanks or tank systems.
