Protection from lawsuits for people who report or help

If you report something in good faith under this part, you are protected from being sued or charged for making that report. You also get the same protection if you take part in a court case that comes from the report. If you take on a duty under this part, you are protected from civil lawsuits for what you do or fail to do within that duty, but the state or private organizations are not protected for their employees' actions.

The statute, as written — Immunity from liability

(a) Anyone participating in good faith in the making of a report pursuant to this part shall have immunity from any liability, civil or criminal, that might be otherwise incurred or imposed by or as a result of the making of such a report. Any participant shall have the same immunity with respect to participation in any judicial proceeding resulting from that report. (b) Any individual who assumes a duty or responsibility pursuant to this part shall have immunity from civil liability for acts or omissions performed within the scope of the individual's duty or responsibility. Nothing in this part shall limit the liability of the department, any other state agency, or any private organization for the conduct of individuals acting within the scope of their duties provided immunity under this section.
