HRS §37-41

Unused state money returns to the general fund

This section says that most state money set aside for a specific purpose must be returned to the general fund if it is not spent or committed by the end of the fiscal year. There are exceptions under other laws, including section 37-41.5. The return process follows section 40-66.

Unless otherwise provided by section 37-41.5 or any other law, every appropriation or part thereof of any kind made subject to sections 37-31 to 37-40, remaining unexpended and unencumbered at the close of any fiscal year shall lapse and be returned to the general fund in the manner prescribed in section 40-66.
