What happens after a complaint is filed

This section explains what happens after someone files a complaint about employment discrimination. The labor department must send the complaint to the employer, who may reply. A hearing will be held under the state's rules for administrative hearings.

The statute, as written — Proceeding and hearing on complaint

(a) After the filing of any complaint, the department of labor and industrial relations shall serve a copy of the complaint upon the employer charged. Service may be by delivery to the employer or by mail. The employer may file an answer to the complaint. (b) A hearing on the complaint shall be held by the department in conformance with chapter 91.
