Employers must pay health costs if they fail to provide coverage

If an employer does not give health coverage as the law requires, the employer must pay the health care costs the employee had during that time. This section makes the employer responsible for those costs.

Any employer who fails to provide coverage as required by this chapter shall be liable to pay for the health care costs incurred by an eligible employee during the period in which the employer failed to provide coverage.
