Conditions Before Signing a Project Agreement

Before or during talks, the department can make the project party pay its fees and costs, even if no deal is signed. The department may require a deposit, returning any extra but keeping interest. A project agreement can only be signed if the legislature approved bonds and the project party is responsible or guaranteed by one.

(a) Prior to entering into negotiations with respect to a project agreement or at any time during the negotiations, the department shall require that as a condition to the negotiations or the continuation thereof, the project party shall agree to pay all fees, costs, and expenses assessed by the department even though a project agreement may not be entered into.
