Denial of preliminary approval to organize

If the state banking commissioner decides an applicant does not meet the requirements for preliminary approval to organize, the commissioner must send a written denial. The applicant can ask for a hearing under state rules, and can appeal the final denial to circuit court.

The statute, as written — Denial of preliminary approval to organize

If the commissioner is not satisfied that the applicant meets all the criteria set forth for preliminary approval to organize, the commissioner shall issue a written decision denying the applicant's application. An applicant who is denied approval may request a hearing before the commissioner in accordance with chapter 91. Any final decision of the commissioner denying an applicant preliminary approval to organize may be appealed to the circuit court as provided in chapter 91.
