You need a bank charter to act as a bank

Unless federal law or this chapter says otherwise, you cannot do bank activities like taking deposits, using the word "bank," or using bank-only powers unless you are a corporation formed in Hawaii and have a bank charter. This section sets that basic rule.

The statute, as written — Necessity for bank charter

Except as expressly permitted by federal law or this chapter, no person shall engage in any activity for which a charter to operate as a bank is required by this chapter, including without limitation the solicitation, acceptance, and holding of deposits in the State, the use of the term "bank", or the exercise of such other powers or privileges restricted to banks under applicable law unless it is a corporation incorporated in this State and has such a charter.
