Who pays when a filed record has a false statement

If someone files a record with a false statement and you lose money because you relied on it, you can sue the person who signed it or had it signed, if they knew it was false. You can recover damages for your loss.

The statute, as written — Liability for false statement in filed record

If a record authorized or required to be filed under this chapter contains a false statement, any person who suffers loss by reliance on the statement may recover damages for the loss from the person who signed the record or caused another to sign it on the person's behalf and knew the statement to be false at the time the record was signed.
