HRS §431:9A-108.5

How out-of-state insurance agents get served with legal papers

This section says that insurance agents who live outside Hawaii must name the state insurance commissioner as their agent for receiving legal papers in Hawaii. If the commissioner is served, it counts as serving the agent. This appointment cannot be canceled while any claim could still come up from their Hawaii business.

The statute, as written — Process against nonresident licensees

(a) Each licensed nonresident producer shall appoint the commissioner as the producer's agent to receive service of legal process issued against the producer in this State upon causes of action arising within this State. Service upon the commissioner as agent shall constitute effective legal service upon the producer. (b) The appointment shall be irrevocable for as long as there could be any cause of action against the producer arising out of the producer's insurance transactions in this State. (c) Service of process on the commissioner shall be made in accordance with section 431:2-206.
