HRS §431:9J-105

When payments to an administrator count as paid

This section says that when you pay insurance premiums to an administrator, the insurance company is considered to have received them. But when the insurance company sends refunds or claim payments to the administrator, you are not considered paid until you actually get the money. The insurance company still has rights against the administrator if the administrator fails to pass payments along.

The statute, as written — Effect of payments to administrator

(a) Payment to the administrator of any insurance premiums or charges by or on behalf of the insured shall be deemed received by the insurer. (b) Payment of return premiums or claims by the insurer to the administrator shall not be deemed payment to the insured until the insured receives the payment. (c) This section does not limit any right of the insurer against the administrator resulting from failure of the administrator to make payments to the insurer or insured.
