HRS §432D-23.6

Exemption for federally funded health plans

This section says that certain required health insurance coverages do not apply to health maintenance organizations (HMOs) that offer insurance through a federally funded program under the Social Security Act. The exemption only covers the part of the HMO's business that is under that federal program.

The statute, as written — Federally funded programs; exemption

Requirements relating to mandated coverages shall not be applicable to any health maintenance organization offering health insurance under a federally funded program under the Social Security Act, as amended; provided that this exemption shall apply only to that part of the health maintenance organization's business under the federally funded program.
