HRS §445-36
Auctioneers can sue buyers in their own name
This section lets an auctioneer file a lawsuit in their own name against a buyer who bought property at their auction. The lawsuit can be to force the buyer to complete the sale or to collect the purchase price. It is a narrow rule about who can sue.
The statute, as written — Auctioneer may sue
Every auctioneer may sue in the auctioneer's own name any person purchasing property sold by the auctioneer at auction, whether to enforce specific performance of the sale or to collect the purchase price thereof.
