HRS §454F-45
State takes over your rights after paying your judgment
If the state's mortgage loan recovery fund pays you because a court ordered it, the state takes over your rights to that judgment. You must give the state your rights, title, and interest in the judgment. Any interest the state collects goes back into the fund.
The statute, as written — Subrogation of rights
When, pursuant to court order, the commissioner has paid any sum to a judgment creditor from the mortgage loan recovery fund, the commissioner shall be subrogated to all of the rights of the judgment creditor. The judgment creditor shall assign all of the judgment creditor's rights, title, and interest in the judgment to the commissioner. Any interest collected by the commissioner pursuant to this section shall be deposited into the mortgage loan recovery fund.
