HRS §482-34
Where to sue to cancel a trademark and how to serve out-of-state owners
This section says that a lawsuit to cancel a trademark registration must be filed in circuit court. The director is not a party but must be told about the case and can join. If the trademark owner lives outside Hawaii, you can serve them using the state's rules for serving out-of-state people.
