Attorney's fees in trade secret cases

In a trade secret lawsuit, the court can order one side to pay the other side's lawyer fees, but only in certain situations. This happens if someone made a false claim, used a court order unfairly, or stole a trade secret on purpose and with bad intent.

The court may award reasonable attorney's fees to the prevailing party if: (1) A claim of misappropriation is made in bad faith; (2) A motion to terminate an injunction is made or resisted in bad faith; or (3) Wilful and malicious misappropriation exists.
