Debts owed to someone who died

If someone owed money to a person who died without a will, that debt is only subtracted from the debtor's own share of the inheritance. If the debtor dies before the person, the debt is not counted against the debtor's children or other descendants.

A debt owed to a decedent is not charged against the intestate share of any individual except the debtor. If the debtor fails to survive the decedent, the debt is not taken into account in computing the intestate share of the debtor's descendants.
