HRS §560:3-903

Offsetting debts against inheritances

If someone inherits from an estate but owes money to that estate, the amount owed is subtracted from what they inherit. If the debt isn't due yet, its current value is subtracted. The person can still use any legal defense they would have if sued for the debt.

The amount of a non-contingent indebtedness of a successor to the estate if due, or its present value if not due, shall be offset against the successor's interest; but the successor has the benefit of any defense which would be available to the successor in a direct proceeding for recovery of the debt.
