Time limits for enforcing a premarital agreement

This section pauses the usual time limit for bringing a legal claim under a premarital agreement while the couple is married. After the marriage ends, the normal time limit applies again. Either spouse can still use fair defenses like waiting too long to enforce the agreement.

The statute, as written — Limitation of actions

Any statute of limitations applicable to an action asserting a claim for relief under a premarital agreement is tolled during the marriage of the parties to the agreement. However, equitable defenses limiting the time for enforcement, including laches and estoppel, are available to either party.
