Background checks without permission in child safety cases

When the state must assess a child's safety, the department can run criminal background checks on the person accused of harm and all adults living in the home, without asking their permission. This is done to keep the child safe.

When an assessment is required pursuant to this chapter, the department may conduct criminal history record checks, without consent, of an alleged perpetrator of harm or threat of harm and all adult household members to ensure the safety of the child.
