What the court looks at when deciding a motion

When a judge decides a motion under section 634G-3(a), they will review the documents filed by both sides and any evidence that would be allowed in a summary judgment motion. This section tells the judge what to consider.

In ruling on a motion under section 634G-3(a), the court shall consider the parties' pleadings, the motion, any replies and responses to the motion, and any evidence that could be considered in ruling on a motion for summary judgment under the applicable Hawaii rules of civil procedure.
