State gives up immunity for employee torts

This section makes the State responsible for harm caused by its employees' wrongful acts, just like a private person would be. However, the State does not have to pay interest before a court judgment or punitive damages.

The statute, as written — Waiver and liability of State

The State hereby waives its immunity for liability for the torts of its employees and shall be liable in the same manner and to the same extent as a private individual under like circumstances, but shall not be liable for interest prior to judgment or for punitive damages.
