Lawsuits against the state are decided by a judge

This section says that lawsuits against the state are heard by a judge, not a jury. However, if everyone involved agrees, the judge can allow a jury trial, and the jury's decision will be treated the same as in any other jury trial.

The statute, as written — Jury

Any action against the State under this chapter shall be tried by the court without a jury; provided that the court, with the consent of all the parties, may order a trial with a jury whose verdict shall have the same effect as if trial by jury had been a matter of right.
