Lawsuits can continue after an injured person dies
If someone is hurt or harmed by another's wrongful act, neglect, or mistake, their right to sue does not end when they die. The lawsuit can be continued by the person's legal representative, and any money won becomes part of the deceased person's estate. This does not apply to defamation or malicious prosecution cases.

A cause of action arising out of a wrongful act, neglect, or default, except a cause of action for defamation or malicious prosecution, shall not be extinguished by reason of the death of the injured person.
