Lender is responsible for its agents' promises

When a lender forecloses on a home, it must follow any agreements, promises, or obligations its agents made on its behalf. This includes employees, representatives, mortgage servicers, and others authorized by the lender. The lender cannot avoid these commitments.

A foreclosing mortgagee shall be bound by all agreements, obligations, representations, or inducements made on its behalf by its agents, including but not limited to its employees, representatives, mortgage servicers, or persons authorized by a foreclosing mortgagee or lender pursuant to an affiliate statement recorded in the bureau of convey ances pursuant to section 667-58 .
