Pleading a prior conviction or acquittal

This section covers a narrow court procedure. If you are charged again for an offense you were already lawfully convicted or acquitted of, you can plead that in court. You only need to state that you were lawfully convicted or acquitted of the same offense.

The statute, as written — Plea of autrefois convict or acquit

In any plea of autrefois convict or autrefois acquit, it shall be sufficient for the defendant to state that the defendant has been lawfully convicted or acquitted (as the case may be) of the offense charged in the indictment.
