DNA and forensic samples are kept private

This section says that DNA profiles, forensic identification information, and biological samples held by the department or law enforcement are confidential and do not have to be shared with the public. They also do not have to be returned to anyone, unless this chapter says otherwise.

The statute, as written — Exemption of specimen from disclosure

(a) All DNA and forensic identification profiles and other identification information retained by the department pursuant to this chapter shall be exempt from any law requiring disclosure of information to the public and are confidential except as otherwise provided in this chapter. (b) All evidence and forensic samples containing biological material retained by the department or other state or local law enforcement agency are exempt from any law requiring disclosure of information to the public or the return of biological specimens, samples, or print impressions.
