HRS §654-8

Choosing how to get your property back

If a court says you own certain property but you don't have it yet, you can choose to get a court order for the property itself or for its money value. If only part of the property is available, you can take that part and get a separate judgment for the missing part's value plus damages.

The statute, as written — Plaintiff's option

If any portion of the property cannot be obtained on execution the party entitled thereto may take the remainder and apply for and obtain a supplementary judgment for the value of the missing portion together with damages.
