Faking illness or hurting yourself to avoid duty

This section makes it a crime for people covered by this chapter to pretend to be sick or disabled, or to hurt themselves, in order to get out of work or duty. If found guilty, a court-martial decides the punishment.

The statute, as written — Malingering

Any person subject to this chapter who, with the intent to avoid work, duty, or service: (1) Feigns illness, physical disability, mental lapse, or mental derangement; or (2) Intentionally inflicts self-injury, shall be punished as directed by a court-martial.
