Releasing or drinking with a prisoner

This section covers two military offenses: letting a prisoner go free without permission or through carelessness, and drinking alcohol with a prisoner. Both are punished by a court-martial, even if the prisoner was not legally committed in the first place.

The statute, as written — Release of prisoner without authority; drinking with prisoner

(a) Any person subject to this chapter who: (1) Without authority to do so, releases a prisoner; or (2) Through neglect or designs, allows a prisoner to escape, shall be punished as directed by a court-martial regardless of whether the prisoner was committed in strict compliance with the law. (b) Any person subject to this chapter who unlawfully drinks any alcoholic beverage with a prisoner shall be punished as directed by a court-martial.
