Criminal penalties for breaking this law

This section adds criminal charges on top of any civil or administrative penalties for breaking this part or its rules. The crime level depends on the value of the agricultural commodity involved. It does not cover other enforcement details.

The statute, as written — Enforcement; criminal penalties

In addition to any civil or administrative penalties or remedies, violations of this part or any rule adopted pursuant thereto shall be criminal offenses and shall be sentenced as follows: (1) Any offense in which the value of the agricultural commodity exceeds $100 shall be a class C felony; and (2) Any offense in which the value of the agricultural commodity is $100 or less shall be a misdemeanor.
