Fines for breaking agriculture and biosecurity rules

The agriculture department can fine anyone who breaks this part of the law or its rules. Each day or separate instance of breaking the rule is a separate offense. The fine process is treated as a civil action, not a criminal one.

The statute, as written — Administrative penalties

The department of agriculture and biosecurity may, after notice and opportunity for hearing, fine any person who violates this part or any rule adopted under this part, not more than $1,000 for each separate offense. Each day or instance of violation shall constitute a separate offense. Any action taken to impose or collect the penalty provided for in this section shall be considered a civil action.
