Swearing to a complaint about a violation

When someone reports a violation of this law or its rules to a prosecutor, the official who issued the citation and summons must swear under oath that the complaint is true. This section only covers that oath requirement.

The statute, as written — Administration of oath

When a complaint is made to any prosecuting officer of the violation of this chapter or the rules adopted pursuant thereto, the division head or the division head's designee who issued the citation and summons shall subscribe to the complaint under oath.
