Swearing to a complaint

This section says that when someone reports a violation of this chapter or its rules to a prosecutor, the division head (or their designee) who issued the citation and summons must swear to the complaint under oath. It is a narrow procedural rule about who must sign the complaint.

The statute, as written — Administration of oath

When a complaint is made to any prosecuting officer of the violation of this chapter or the rules adopted pursuant thereto, the division head or the division head's designee who issued the citation and summons shall subscribe to the complaint under oath.
