Who pays the costs of a court citation case

If a circuit court says there is good reason to issue a citation and start a case under this law, the finance director must pay the costs of serving the citation and other legal expenses from a special tax fund, unless those costs were already paid.

Whenever a circuit court certifies that probable cause exists for issuing a citation and taking proceedings under this chapter, the director of finance shall pay from the tax reserve fund provided in section 231-23(c)(2), or allow all expenses incurred for services of citation and other lawful disbursements that have not otherwise been paid.
