Selling unstamped cigarettes from a vending machine

This law makes it a serious crime to knowingly put unstamped cigarettes in a vending machine for sale. A company that breaks this rule can also be fined. The law applies to actions starting April 1, 2001.

The statute, as written — Vending unstamped cigarettes

(a) Beginning April 1, 2001, any person who knowingly places for sale in a cigarette vending machine any cigarettes not contained in cigarette packages to which are affixed stamps as required by this part, shall be guilty of a class C felony. (b) In addition to any other authorized disposition, a corporation found in violation of subsection (a) may be fined in an amount not to exceed $50,000.
