ABLE account funds are protected and may be claimed by Medicaid

Money in an ABLE savings account is protected from being taken by creditors through legal actions like attachment, execution, or garnishment. However, Medicaid may claim the money, but only within limits set by the federal Secretary. This section is narrow and only covers these two points.

Moneys in an ABLE savings account: (1) Shall be exempt from attachment, execution, or garnishment as provided by section 651-124; and (2) May be claimed by the medicaid plan subject to limitations imposed by the Secretary.
